Terms
1. Provider and scope

These terms apply to the use of maps.express – the website, the public demo and the map studio at my.maps.express – by consumers and businesses. Our customers' own terms apply only if we agree to them in writing. For businesses with a framework agreement of their own, that agreement takes precedence.
2. What maps.express provides
In the map studio you design maps of trips, routes and places and download them as an image, a vector graphic or a print file. The demo and simple exports are free; the export dialog shows which formats, resolutions and licences are paid before you buy. We keep developing the studio and may change features as long as the core of what you bought remains.
3. Your account
To save and buy, you sign in with your email address and a one-time code; this creates a personal space for your maps. Keep access to your mailbox secure – anyone who receives your codes can use your account. You can have your account deleted at any time via hello@maps.express.
We automatically delete a personal space in which, 90 days after it was created, no map has ever been saved and nothing has been bought. Accounts with maps or purchases are not affected.
4. Purchase and payment via Polar
Paid exports are sold by Polar Software, Inc. as reseller (Merchant of Record). Your purchase contract is with Polar; Polar handles payment, invoicing and sales tax, and Polar's terms additionally apply to the checkout. We provide the purchased service. All prices are shown before you buy and include statutory VAT where applicable.
The file is released only after payment is confirmed. If a paid export cannot be produced for technical reasons, you receive it later or get your money back.
5. Right of withdrawal for consumers
As a consumer you generally have a statutory right of withdrawal when you buy; Polar provides the withdrawal notice during checkout. Because the map is provided immediately as a digital file, the right of withdrawal expires once the download begins, provided you have expressly agreed beforehand that we deliver before the withdrawal period ends and confirmed that you thereby lose your right of withdrawal.
6. Your content and your rights of use
Texts, images and routes you bring in remain yours. You grant us only the rights we need to store and display them and to produce your maps. You are responsible for being allowed to use this content.
For exported maps you receive a simple, perpetual right of use within the licence you chose: private for your own non-commercial purposes; commercial for your company's advertising, websites and publications; print for print runs in catalogues, brochures and similar printed works. Free exports may be used privately. Reselling the map files as such, for example as templates or stock graphics, is not permitted.
An unlock covers one map and its revisions. If it turns into a substantially different map, a new unlock is needed.
7. Third-party map data and attribution
Our maps are partly based on open third-party data, such as OpenStreetMap (Open Database License, ODbL) and Natural Earth (public domain). We record which sources a map contains in the export – visibly on the map and in the file's metadata. Where attribution is required, it must remain recognisable in every publication; do not remove or cover it. Rights to third-party data remain with their authors.
8. Fair use
Please use maps.express only as intended: no automated bulk retrieval outside our interfaces, no circumventing limits, payment steps or security measures, and no unlawful, offensive or infringing content. In case of violations we may block access; exports already paid for and used properly remain yours.
9. Availability
We strive for smooth operation but do not owe uninterrupted availability. Maintenance, security updates and outages at service providers may temporarily limit the studio. Keep downloaded files yourself.
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slight negligence we are liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for the contract. Maps are a design medium, not a basis for navigation or planning; routes, distances and borders may be simplified or inaccurate.
11. Data protection
How we process personal data is explained in our privacy policy.
12. Changes to these terms
If our services or the law change, we adapt these terms. We inform you in advance of changes affecting your account by email or at your next sign-in; purchases already completed remain unaffected.
13. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as mandatory consumer protection provisions of the country of their habitual residence do not take precedence. The place of jurisdiction for merchants is Berlin. We do not take part in dispute resolution proceedings before a consumer arbitration board and are not obliged to do so.
